$347,637.34: TOTAL CITY EXPENDITURE FOR SALE OF THE FLANDERS MANSION PROPERTY

ABSTRACT: Since March 2005, prior to the City Council’s unanimous vote to sell the Flanders Mansion property (1.25 acres) at a Special Meeting on September 22, 2005, the City has expended and/or agreed to expend $243,448 in attorney fees, $102,689.34 in consultant’s fees for the Environmental Impact Reports and $1,500 in an appraisal fee for a total of $347,637.34.

Pursuant to Government Code Section 54956 et seq. of the State of California, the City Council will adjourn to Closed Session to consider the following:

A. Existing Litigation - Government Code Section 54956.9(a)- Conference with legal counsel regarding The Flanders Foundation, a California Nonprofit Public Benefit Corporation, Petitioner v. City of Carmel-by-the-Sea, Respondents - Monterey County Superior Court Case No. M76728.

In closed session, the City Council decided not to appeal Judge Robert A. O’Farrell’s decision and agreed to compensate Flanders Foundation attorney Susan Brandt-Hawley $160,000 in taxpayer funds.

Cities take pride in their historic resources. It is unheard of for a city to sell a National Register of Historic Places structure into private hands. Carmel supposedly took pride in having 300 historic buildings on the city’s inventory, but the city doesn’t take pride in a National Register property and refuses to form an alliance with the Flanders Foundation and find a low key, appropriate use for Carmelites, visitors and even the Hatton Fields neighbors to enjoy Flanders Mansion. With a modicum of imagination, it could conceivably be the focal point of Mission Trail Park. Instead our council of fools spends hundreds of thousands of dollars, for what, not to rehabilitate the building, but to pay consultant and legal fees in a foolish attempt to sell it. This whole thing makes me nauseous and sick to my stomach.

What a bogus claim. The city doesn't have any monies to maintain Flanders Mansion, but the city has $350,000 to pay consultants and lawyers to sell Flanders Mansion. The entire city is a hoax and a joke!

Along those same lines, Carmel spends hundreds of thousands of dollars to a nonprofit to operate the Sunset Center and hundreds of thousands of dollars in tourist promotion and marketing, yet Carmel's line is it doesn't have the money to comply with its municipal code to maintain a historic structure entrusted to them by the public. Now that's bizarre logic.
