CONCLUSION For all of the reasons stated above, all of MCWD’s evidence that Cal-Am seeks to exclude from the Commission’s consideration is relevant to issues of consequence in this proceeding, as set forth in the Issues Ruling. None of the challenged MCWD testimony impermissibly states a legal conclusion. Cal-Am’s motion to strike constitutes yet another attempt by Cal-Am to silence opinions contrary to its own view and to deprive the Commission of a full and up-to-date factual record. Cal-Am’s motion to strike should be denied.
