UPDATE I: At the 7 June 2011 City Council Meeting, during Announcements from Closed Session, City Attorney Don Freeman made announcements to the public, as follows:

Existing Litigation - Government Code Section 54956.9(a) – Conference with legal counsel regarding the Monterey Peninsula Water Management District v. State Water Resources Control Board, et al. Santa Clara County Superior Court Case No. 1-10-CV163328.

Currently the Cities of Carmel, Seaside and Monterey have retained legal counsel, namely Brownstein Hyatt Farber Schreck, Santa Barbara, to deal with the State Water Board in mediation regarding the Cease and Desist Order. He anticipated mediation will end “favorably” within the next 90 days. The request of the City is to sign a waiver of conflict of interest due to the fact that the attorney representing CalAm will be joining Brownstein Hyatt Farber Schreck. Council unanimously voted for the City to sign waiver of conflict of interest.

2. Existing Litigation - Government Code Section 54956.9(a) - Conference with legal counsel regarding J. Marosi v. S. McCloud, Santa Clara County Court Case No. 211SC08019.

City Attorney Don Freeman stated that a small claims court action has been filed against Mayor Sue McCloud individually. The case “appears to be meritless because Sue McCloud has had absolutely no contact with the plaintiff or the other defendants.” The Court scheduled a hearing on July 8 on its own motion to discuss whether case should be dismissed because plaintiff is being considered a “vexatious litigant.”  The City has notified the plaintiff to dismiss lawsuit with prejudice. If the plaintiff does not dismiss the suit or the Court does not dismiss the suit, then the City will defend the lawsuit in Superior Court. The Council unanimously voted (McCloud abstained) to authorize a defense for Mayor Sue McCloud.

Case information is provided; Marosi alleges that, "Carlos Porras has an illegal arrangement with the Mayor of Carmel, Sue Mc Cloud, and the consumer fraud attorney, Robert Lauchlan who protects Carlos from any and all demands by artists to suspend his license to operate his gallery” and “Mayor Sue Mc Cloud and Robert Lauchlan have participated with Porras as accessory after the fact to allowing him to victimize artists by stealing either their paintings or their commission.”

As alleged by Gilbert Marosi, "Carlos Porras has been illegally operating an art gallery in Carmel for about fifteen years. During this time he seldom pays artists for their commission. He allegedly has at his gallery, Canapo, an inventory of about $1,000,000 of art objects stolen from their rightful owners."

In papers filed for that case Marosi alleges that, "Carlos Porras has an illegal arrangement with the Mayor of Carmel, Sue Mc Cloud, and the consumer fraud attorney, Robert Lauchlan who protects Carlos from any and all demands by artists to suspend his license to operate his gallery."

In Papers filed for that case Mayor Sue Mc Cloud and Robert Lauchlan have participated with Porras as accessory after the fact to allowing him to victimize artists by stealing either their paintings or their commission," alleges Marosi. "The following artists have also allegedly been victimized: Angela Rubio for $2,000; Don Becker for $10,000; Claudia for $8,000; Chcklein for $450; Gilbert Marosi for $14,000; Hugo Lecaros for $3,270; Jeff Schaub for $5,000; and Charles Carter for $5,000."

Well, well Susan A. McCloud is at it again. Faced with coming to the aid of victim Jane Miller or aiding the harasser Rich Guillen, the mayor assisted, enabled and defended the harasser. Here, faced with coming to the aid of artist victims or enabling the alleged art gallery owner perpetrator, the mayor apparently sided with the perpetrator. I hope Gilbert Marosi finally exposes Sue McCloud for the villain she is.
