RESPONDENT’S BRIEF ARGUMENTS include THE SUPERIOR COURT PROPERLY DETERMINED THAT MARINA COAST WAS THE LEAD AGENCY UNDER CEQA, THE SUPERIOR COURT PROPERLY DETERMINED THAT THE EIR IS LEGALLY INADEQUATE, including Water Rights, THE SUPERIOR COURT HAD JURISDICTION OVER THE CEQA CHALLENGE TO MARINA COASTS ACTIONS, MARINA COAST'S REMAINING AFFIRMATIVE DEFENSES ARE WITHOUT MERIT and THE SUPERIOR COURT PROPERLY DENIED MARINA COAST'S MOTION TO AUGMENT THE ADMINISTRATIVE RECORD. CONCLUSION For each of the reasons stated above, and the interests of justice, Respondent Ag Land Trust requests that this Court affirm the Judgment.
