Steven McInchak, Claimant, v. City of Carmel NOTICE OF GOVERNMENT CLAIM FOR DAMAGES AGAINST THE CITY OF CARMEL-BY-THE-SEA

ABSTRACT: The NOTICE OF GOVERNMENT CLAIM regarding Steven McInchak’s claim for damages against the City of Carmel, dated December 4, 2013, is embedded. The Claim of Information Systems Network Manager Steve McInchak states, in part, that the “City of Carmel violated Claimant’s rights under the United States Constitution, the California Constitution and under California and Federal law, including it s own governing Personnel System Ordinance.” HIGHLIGHT EXCERPTS are presented.

HIGHLIGHT EXCERPTS:
  • On June 5, 2013, without notice or warning, Claimant was visited at his home by Administrative Services Director, Susan Paul, together with Mark Alcock, represented to be a forensic computer investigator retained by the City of Carmel, a Monterey County Sheriffs Deputy, the Carmel Police Chief and two officers of the Cannel Police Department, who served upon him a search warrant and proceeded to search his residence. Agents for the City of Carmel took possession of his home computer and multiple thumb drives and disks, which have not been returned. The City also took possession of a City-owned laptop computer which had multiple City users in the past. At that time Claimant was also given a notice by Ms. Paul that he was placed on paid administrative leave pending investigation of undisclosed charges. Prior to that time Claimant had no knowledge or notice of any such allegations, no opportunity to respond to the allegations, and no hearing or other means to refute false, misrepresented and unsupported allegations. Claimant and his family were extremely distressed by the unannounced appearance at his home of the Administrative Services Director, Susan Paul, and by the actions of agents of the City of Carmel. Claimant has remained on administrative leave of absence from his employment with the City of Carmel since June 5, 2013 to the present, and he has been prevented from performing his job duties, retrieving personal property from his office or accessing his computer, his office computer or the City's laptop computer.
  • Agents of the City of Carmel, including administrators and elected officials, disclosed confidential personnel information concerning Claimant to news media, to reporters, to other employees and to the public, and made or caused to be published false and defamatory statements charging Claimant with criminal activity and other statements which injured Claimant and irreparably damaged his reputation in his profession, his employment, and his community.
  •  …agents of the City of Carmel defamed Claimant by publishing to news media reporters, other employees, the general public and other persons false, unprivileged and defamatory statements charging Claimant with a crime and other statements which exposed Claimant to hatred, contempt, ridicule or obloquy, causing him injury and tending to injure him in respect to his profession and employment, and causing irreparable loss of his reputation in the community.
  • RESPONSIBLE OFFICIALS: Jason Stilwell, Susan Paul, Jason Burnett and other agents of the City of Carmel whose identities are unknown at this time.

John Hanson, Claimant, GOVERNMENT CLAIM FOR DAMAGES AGAINST THE CITY OF CARMEL-BY-THE-SEA

ABSTRACT: The GOVERNMENT CLAIM document regarding John Hanson’s claim for damages against the City of Carmel-by-the-Sea, dated December 17, 2013, is embedded. The Claim of Claimant John Hanson, former Building Official, states, in part, that “The City of Carmel-by-the-Sea violated Mr. Hanson's rights under the United States Constitution, the California Constitution and California and Federal law, including the City's own governing ordinance” and “The City of Carmel-by-the-Sea's actions constituted wrongful termination of Mr. Hanson in violation of California law.” HIGHLIGHT EXCERPTS are presented.

HIGHLIGHT EXCERPTS:
  • Beginning in March 2013, and leading to unlawful action taken against Mr. Hanson in August 2013, the City undercut Mr. Hanson, interfered with his performance of his duties, and misrepresented his work. The incidents giving rise to this claim show a course of conduct whereby top City administration (Jason Stilwell and Susan Paul, among others), interfered with Mr. Hanson's duties and Building Department operations, sometimes without conferring with, or even informing Mr. Hanson, unduly criticized Mr. Hanson about his job performance and qualifications, took contradictory and inconsistent positions, discriminated against Mr. Hanson based on age, medical condition/disability, and status as an active duty member of the military, and generally created a hostile work environment for Mr. Hanson, leading to his termination without any basis and without any due process given.
  • The City of Carmel-by-the-Sea's actions constituted wrongful termination of Mr. Hanson in violation of California law.
  • The agents of the City of Carmel-by-the-Sea defamed Mr. Hanson by publishing to other employees, the general public and other persons false, unprivileged, defamatory, and slanderous statements charging Mr. Hanson with misconduct and lack of credentials and other statements which exposed Mr. Hanson to hatred, contempt, ridicule or obloquy, causing him injury and tending to injure him in respect to his profession and employment, and causing irreparable loss of his reputation in the community.
  • The agents of the City of Carmel-by-the-Sea unlawfully discriminated against Mr. Hanson because of his age, in violation of the California Fair Employment and Housing Act, Government Code section 12900 et seq. and the Older Americans Act. The actions of the City to arbitrarily suspend or fire employees during the past year have a disparate impact upon older workers, and the City's tactics were intended to, and did, abuse the processes of involuntary leave and summary terminations in order to scare and intimidate employees of the City, prevent them from testifying about what they have seen and learned, and force them from their employment for money-saving reasons that cause harm to the employees.
  • The agents of the City unlawfully discriminated against Mr. Hanson due to his medical-related disability and history (post-traumatic stress disorder), and failed to accommodate his medical-related disability in violation of the California Fair Employment and Housing Act, Government Code section 12900 et seq. and the Americans with Disabilities Act.
  • The City Carmel-by-the-Sea unlawfully discriminated against Mr. Hanson because of his employment with the military in violation of Military leave laws (Mil. & Vet. Code,§ 389 et seq.) and the Uniformed Services Employment and Reemployment Rights Act (USERRA).
  • The actions of the City of Carmel-by-the-Sea constitute retaliation against Mr. Hanson for whistleblowing about the City's improper and discriminatory conduct. (Lab. 23 Code,§ 1102.5.)
  • RESPONSIBLE OFFICIALS: Jason Stilwell, City Administrator, and other employees, agents, officers, and officials of the City of Carmel-by-the-Sea whose roles and actions are not fully known at this time.

In a decision issued late Tuesday, San Francisco Superior Court Judge Curtis Karnow ruled state law bars Cal Am from challenging the regional project agreements beyond 60 days after they were approved, but the county is allowed four years to challenge the validity of the regional project agreements under state law allowing challenges to contracts involving a conflict of interest.
The county, according to Karnow's ruling, has time to challenge the agreements. 


ABSTRACT: In SUPERIOR COURT OF CALIFORNIA, COUNTY OF SAN FRANCISCO, CALIFORNIA-AMERICAN WATER CO., Plaintiff, vs. MARINA COAST WATER DISTRICT, ET AL., Defendants. AND RELATED CROSS ACTIONS, ORDER DENYING MOTION OF MARINA COAST WATER DISTRICT FOR SUMMARY JUDGMENT ON ITS CROSSCOMPLAINT OR IN THE ALTERNATIVE SUMMARY ADJUDICATION OF EACH 7 CAUSE OF ACTION IN ITS CROSSCOMPLAINT; AND GRANTING MOTION OF MARINA COAST WATER DISTRICT FOR SUMMARY ADJUDICATION OF THE FIRST CAUSE OF ACTION IN CAL-AM'S COMPLAINT, by Curtis E.A. Karnow. Judge of The Superior Court, is embedded.  Importantly, “As a result, Marina's motion for summary adjudication as to the first cause of action in Cal-Am's Complaint is granted- Cal-Am is barred from seeking to void these agreements by the validation statutes. On the other hand, Marina's motion for summary adjudication of the first cause of action in its Cross-Complaint is denied. On the present record, Monterey's time for challenging the validity of the agreements under § 1 092 has not expired.”  And “Accordingly I conclude that the suit before me would not violate the rules of administrative finality such as those in P.U.C. §§ 1709, 1731(b) and 1756(£) and 1759(a). Marina's motion for summary adjudication is denied as to causes of action 4-7 of its Cross-Complaint.” Conclusion For these reasons, Marina's motion is granted with respect to the first cause of action in Cal-Am's Complaint and denied in all other respects.

ABSTRACT: Re: In the Matter of the Application of California American Water Company (U 210 W) for Approval of the Monterey Peninsula Water Supply Project and Authorization to Recover All Present and Future Costs in Rates, MARINA COAST WATER DISTRICT’S OPENING BRIEF ON THE SETTLING PARTIES’ MOTIONS TO APPROVE SETTLEMENT AGREEMENT AND SETTLEMENT AGREEMENT ON PLANT SIZE AND OPERATION document, including ATTACHMENT 1, is embedded. CONCLUSION
Because the MPWSP Settlement and the Sizing Settlement, as proposed, are not reasonable in light of the whole record, are not consistent with law, and are not in the public interest, they cannot be approved.
The project must be configured to avoid impairment of the 1996 Annexation Agreement and injury to MCWD and other users of SVGB groundwater, and to comply with the Agency Act and other applicable laws. The entire project’s potential environmental impacts and reasonable alternative projects must be thoroughly examined through the Commission’s completion, evaluation and certification of its Subsequent EIR, and its exploration of the environmental impacts of the project at a hearing.
Absent revisions to the MPWSP and the Settlements that resolve the legal problems posed by the project’s non-compliance with law and its impairment of MCWD’s interests, and absent the Commission’s lawful resolution of the environmental review issues raised above, MCWD respectfully requests that the Commission deny both the motion for approval of the MPWSP Settlement and the motion for approval of the Sizing Settlement.

Highlight Excerpts: 
A judge could decide by the end of the month whether California American Water and the Monterey County Water Resources Agency were legally allowed to dump the regional desalination project when they did.
That decision could go a long way toward determining which of the three former project partners, including the Marina Coast Water District, will end up responsible for covering millions of dollars in spending on the regional desal project, the key issue in ongoing civil litigation.
If the judge rules in Marina Coast's favor and finds the project agreements are still valid, Markman said "it means we want our money back."
If the judge rules against Marina Coast, the suit could proceed to trial, set to begin March 24.
The company filed its lawsuit against the county and Marina Coast in late 2012, asking the courts to find the project agreements were voided and that the public agencies should be held responsible for the costs.
