UPDATE ON TAXPAYER EXPENDITURES TO MARK ALCOCK, FORENSIC EXAMINER (May 2013 – May 2014)

ABSTRACT: As documented in the SUPERIOR COURT OF CALIFORNIA County of Monterey SEARCH WARRANT, Carmel Police Officer Rachelle Lightfoot stated that Forensic Examiner Mark Alcock “told me that on 02—27-13, he was retained by the city of Carmel to do an examination of McInchak’s work computer” and “Alcock told me that he had been working with McInchak under the ruse that he was conducting an audit of the City’s computer system and servers.” As of the City’s May 2014 Check Register, taxpayer expenditures to Mark Alcock, Forensic Examiner, total $273,486.29, according to the City’s Check Registers.  MARK ALCOCK Check Register Items are reproduced.  In Summary, total expenditures per month:

The most dangerous are government lying (about the existence of documents, for example), particularly in circumstances where officials lie with impunity. Almost as dangerous, but less obviously so, are situations in which government agencies restructure the way they do business for the sole purpose of gaining legal cover to deny requests for information .”  “Another example: Local governments that hire a law firm not primarily for legal advice or legal representation, but to perform the nonlegal function of management consulting, typically on a specific transaction. Why would government officials do that? Certainly not to save money or to get superior business or technical advice. No, a local government would do this so that all communications with its advisers, all information exchanged with them, and all expert reports or analyses commissioned for the city’s use in deciding whether to go forward with a transaction, and selling that decision to voters, can be characterized—fairly or not— as covered by the attorney-client privilege. That label effectively immunizes all records from FOI laws.”

Thomas Peele, Watchdog Columnist, Bay Area News Group: City Administrator Jason Stilwell ‘incompetent or recalcitrant’

ABSTRACT:  “AN AWARD-WINNING investigative reporter — who also teaches graduate students at UC Berkeley about the Public Records Act and heads a committee on freedom of information for the Society of Professional Journalists — said Thursday he’s encountered more resistance from Carmel city administrator Jason Stilwell than almost any other government official when asked to comply with laws requiring disclosure of public documents,” according to the news article entitled “Stilwell: Most secretive gov’t. official in state?” By MARY SCHLEY, The Carmel Pine Cone, June 20, 2014, 1A, 12A. “Thomas Peele, who works for the Bay Area News Group and other media outlets, and has been publishing salary information of Northern California cities, counties, school districts and special districts for the past six years, sent Stilwell a routine request for information about city salaries— the same request that many cities and counties receive — on April 30.”  Peele’s Public Records Act request from the City’s PUBLIC RECORDS REQUEST LOG, City Council Agenda Packet, June 2014, as follows:

“But instead of getting a spreadsheet of the data as he expected, on May 16, Peele was sent a pdf with numbers that can’t be sorted or evaluated for different criteria, such as the highest-paid worker, or the person who earned the most overtime. And when he specifically asked for a spreadsheet or other electronic database, his request was ignored." 
“The issue boils down to the fact that the city provided a record in a pdf, when what we asked for was an electronic record — a spreadsheet or, exactly as the PRA says, ‘the records in the electronic format in which they are held,’” Peele said. “A pdf is a static copy of an electronic record. It’s a silly response by the city to release a pdf,”” according to The Carmel Pine Cone. Yet, after eight months of stalling, City Administrator Jason Stilwell finally provided a spreadsheet of salary information for calendar years 2011 and 2012 to Transparent California; links to “All salaries for Carmel (2012)” and “All salaries for Carmel (2011)" spreadsheets are provided.  Parenthetically, the City of Carmel-by-the-Sea provided 2011 and 2012 salary information to Transparent California in Excel format on February 28, 2014 at 5:14 P.M., according to Robert Fellner, Project Manager, Transparent California, the same day The Carmel Pine Cone published “Watchdog group criticizes city for hiding salary data,” MARY SCHLEY, The Carmel Pine Cone, February 28, 2014, 1A, 13A.
NOTE: “In response to Peele’s email to Burns and the council, Stilwell wrote June 13, “Mayor and Council: The city responded to the Public Records Act request below within 10 days. We created a document in order to fulfill the response. The recipient was not satisfied with the format of the document, assuming there was a report we generated off the city’s system that was producible (there is not). The information requested has been provided in the breakdown requested,” according to The Carmel Pine Cone. SUMMARY:  A draft report documenting the summary of operations for Water Year 2013 at the Seaside Basin Aquifer Storage and Recovery (ASR) Project sites has been prepared by the District’s technical consultant on the project, Pueblo Water Resources, Inc.  The draft report can be viewed on the Monterey Peninsula Water Management District (MPWMD or District) home webpage under “Water Supply Projects”.  The report documents the ASR activities conducted cooperatively with California American Water (Cal-Am) at the Phase 1 and 2 ASR sites during WY 2013, including:  (a) summary of project status and injection well performance, (b) seasonal recharge operations, and (c) water-quality monitoring.  During WY 2013, which was the second consecutive hydrologic “dry year”, injection operations were commensurately reduced from earlier years.  A total volume of 294.5 acre-feet (AF) of Carmel River Basin source water was injected and stored in the Seaside Basin during the winter high-flow season for subsequent recovery during the low-flow dry season.  This contrasts with the over 1,100 AF that were injected during each of the WY 2010 and 2011 recharge seasons.  The completion of this annual report is a requirement of the Central Coast Regional Water Quality Control Board (RWQCB) as part of their ongoing oversight of the ASR program in the Seaside Basin.
RECOMMENDATION:  The Board should receive the draft report documenting ASR activities at the ASR project sites during WY 2013.  If this item is adopted along with the Consent Calendar, the report will be finalized and distributed, subject to inclusion of comments from the District, Cal-Am or other interested parties.
BACKGROUND:  The District has been pursuing Aquifer Storage and Recovery (ASR) in the Seaside Basin since 1996.  The project concept entails diverting excess winter flows from the Carmel River Basin approximately six miles through existing Cal-Am distribution system pipelines to the hydrologically-separate Seaside Basin, where the water is injected into specially-constructed ASR wells, for later recovery during dry periods.  Prior to injection, the diverted water is treated at Cal-Am’s Begonia Iron Removal Plant in Carmel Valley so that it meets potable drinking water standards.   In 1998, the District constructed a pilot injection well, known as the Paso Robles Test Injection Well (PRTIW) in the northeastern portion of the City of Seaside.  The 460-feet deep pilot well was screened in the Paso Robles Formation aquifer.  Subsequent injection testing at the pilot well provided data that allowed the District to proceed with construction of a larger injection test well, SMTIW No. 1 (now referred to as ASR-1), for which construction was completed in 2002 on the former Fort Ord Military Reservation, approximately 300 feet east of the PRTIW.  This site is known as the Phase 1 or Santa Margarita ASR facility.  ASR-1 is an 18 inch-diameter, 720 feet deep stainless steel well screened in the Santa Margarita Sandstone aquifer.  The Santa Margarita aquifer has more favorable hydrogeologic characteristics, and is therefore more conducive to a full-scale ASR project in the basin.  ASR-2 was drilled in 2007 and equipped with permanent pump and motor in 2008.  ASR-2 is larger and deeper, at 22 inches in diameter and 790 feet deep.  In recent years, District staff has been working with the City of Seaside and the Fort Ord Reuse Authority in order to expand the Santa Margarita ASR site to incorporate needed space for pipelines, treatment equipment, and well capacity.
Also in 2008, the District began negotiations with the Monterey Peninsula Unified School District (MPUSD) for potential use of an unused portion of the Seaside Middle School property for a second phase of ASR expansion.  This was followed by successful exploration work at the site in 2009 and an easement for the site was acquired by Cal-Am in 2011.  The District has been working under contract with Cal-Am to complete construction of permanent ASR facilities at this Phase 2 ASR site.
The draft WY 2013 report has been provided to Cal-Am staff for their review and comment.  The report, once finalized, will be sent to the resource agencies that are overseeing authorization of the ASR activities, including the RWQCB.  The report will also be a useful reference document to support future operations and testing at the ASR Project sites.
IMPACT ON STAFF/RESOURCES:  A significant staff effort has been expended planning, coordinating, and overseeing work on the District’s ASR program in the Seaside Basin.  It is planned to continue this level of effort during the remainder of this year and into the next recharge season.

Monterey Bay Regional Water Project: CEO Brent Constantz, DeepWater Desal, Hosted Symposium at Moss Landing Marine Laboratories Presenting Environmental Impact Studies

ABSTRACT: On Monday, June 16, 2014, CEO Brent Constantz, DeepWater Desal, and his team, hosted a symposium at Moss Landing Marine Laboratories presenting environmental impact studies. “The studies are intended to help inform the environmental impact report for the proposal. Dubbed the Monterey Bay Regional Water Project, it calls for co-locating a desal plant capable of delivering up to 25 million gallons of potable water per day at the Moss Landing power plant site. The plant would convert ocean water from a submarine canyon deep below the surface of the Monterey Bay to drinking water aimed at supplying regional needs,” according to reporting in The Monterey County Herald. The State Lands Commission will serve as the lead agency for the environmental review process. Importantly, the Monterey Peninsula Water Management District “has identified the proposal as a potential back-up supply to California American Water's proposed desal project north of Marina.” Links to information from the DeepWater DESAL website are presented.

ABSTRACT: On June 11, 2014, H. Nelson Meeks, Attorney for Stephen Collins, filed a Complaint in Federal Court, San Francisco, alleging Fraud, Conspiracy and Collusion against eight Defendants, on behalf of the Plaintiff, Stephen Collins. The Defendants are the County of Monterey; Curtis V. Weeks, former County Water Resources Agency Head; County Counsel Charles McKee; Deputy County Counsel Irv Grant; Supervisor Lou Calcagno; Supervisor Dave Potter; California American Water Agency President Robert Maclean and California American Water Company. On Thursday, June 12, 2014, Collins' San Francisco attorney Nelson Meeks issued a press release Re: Filing of Federal Lawsuit. Significantly, Meeks states that Collins' “participation in the Regional Project was orchestrated by the BOS, CAL AM and AWC. These entities had full knowledge of Mr. Collins' working relationship with RMC and on two occasions blessed his working relationship with County legal opinions, which will be introduced in trial. The BOS, CAL AM and AWC, with malice and outrageously deceptive conduct, caused Mr. Collins irreparable harm with their fraudulent statements and complete disregard for the truth in disclaiming any knowledge of Mr. Collins' activities. CAL AM withdrew from the Regional Project, on September 28, 2011, due to "the conflict of interest of Mr. Stephen Collins" and after the "exhaustive good faith efforts at remediation with MCWD."”  The lawsuit asks for $5 million per defendant, a total of $40 million, plus damages.

Forest Theatre Update by City Administrator Jason Stilwell: 'Preliminary Cost Estimate of Two to Four Million Dollars’ for ‘Necessary Repairs and Alterations’ to Reopen Forest Theatre

ABSTRACT:  After the Forest Theater Workshop on May 5, 2014 and at the City Council Meeting on June 3, 2014, Announcements from City Administrator, City Administrator Jason Stilwell stated that the City had hired an architect to prepare a “draft punch list” for deficiencies that need to be remedied prior to the reopening of the Forest Theater, the building official reviewed the list and considers the list “comprehensive” and the “preliminary cost estimate of two to four million dollars” for the “necessary repairs and alterations” to reopen the Forest Theatre. After construction plans defined, permitting and bid process, construction now proposed for 2016-2017, moved up one year. Mayor Jason Burnett stated that there will be an opportunity to talk about the Forest Theater at the upcoming budget meeting on Tuesday, June 10, 2014.
