COMMENTS:
In The Carmel Pine Cone’s 1 September 2006 Editorial, Paul Miller compares the lawsuit filed by the Flanders Foundation against the City of Carmel-by-the-Sea et al. for the City Council’s decision to sell the Flanders Mansion Property to lawsuits based on “flimsy grounds,” such as the asbestos, breast implants, cigarettes, mold and disability access lawsuits. He further pontificates that the “Loser” should pay. First, perhaps Mr. Miller could take the time to read and comprehend GNM76728 prior to publishing fraudulent analogies. Secondly, perhaps “Justice” would be for the City Council of Carmel-by-the-Sea to follow the rule of law, particularly as it involves the sale of “parkland.” Thirdly, as he writes, “But if the city loses, there is a very good chance the taxpayers will be ordered to pay the other side’s legal costs.” Again, if the city loses, perhaps this means that the City Council should either have followed the law and/or found a suitable public use for the Flanders Mansion Property, rather than the easy and expedient policy of voting to sell a National Register of Historic Places City-owned property in Mission Trail Nature Preserve, a public park.
