Proceeding Number A.12-04-019 COMMENTS OF THE SETTLING PARTIES ON PHASE 2 SCHEDULE IN RESPONSE TO THE AUGUST 21, 2014 RULING OF ALJ MINKIN

ABSTRACT: Re: In the Matter of the Application of California American Water Company (U 210 W) for Approval of the Monterey Peninsula Water Supply Project and Authorization to Recover All Present and Future Costs in Rates, COMMENTS OF THE SETTLING PARTIES ON PHASE 2 SCHEDULE IN RESPONSE TO THE AUGUST 21, 2014 RULING OF ALJ MINKIN document is embedded. “The Parties support altering the Phase 2 schedule so it is commensurate with the cumulative eleven month postponement reflected in the January 2014 ALJ Ruling and the August 2014 ALJ Ruling. Such alteration would provide time necessary for proponents of the GWR project to complete the milestones identified in Section 4.2 of the July 31, 2012 Settlement Agreement prior to the testimony date.” And Schedule should revert back to a schedule containing time periods between events comparable to those contained in the Amended Scoping Ruling and propose the following new dates:
(i) Testimony of Interested Parties – November 2015
(ii) Settlement Discussions – commencing in December 2015
(iii) Concurrent Rebuttal Testimony – December 2015
(iv) Evidentiary Hearings – January 2016
(v) Briefing – February 2016
(vi) Proposed Decision – May 2016
(vii) Final GWR Decision – June 2016

Proceeding Number A.12-04-019 SETTLING PARTIES’ JOINT COMMENTS ON RULING REQUESTING COMMENTS ON SURCHARGE OPTIONS AND PROPOSALS

ABSTRACT: Re: In the Matter of the Application of California American Water Company (U 210 W) for Approval of the Monterey Peninsula Water Supply Project and Authorization to Recover All Present and Future Costs in Rates, 019 SETTLING PARTIES’ JOINT COMMENTS ON RULING REQUESTING COMMENTS ON SURCHARGE OPTIONS AND PROPOSALS document is embedded. CONCLUSION The Joint Commenting Parties do not support the surcharge proposals created by DWA. Those proposals do not protect ratepayers if this project fail to move forward, would fund a project that the Commission has not yet approved and that lacks a CPCN, (in violation of D.06-12-040), do not limit the funds that can be added to Surcharge 1, and upset the balance of the parties’ interests and the public’s interest. The proposals also appear to reflect an erroneous understanding of the Settlement Agreement’s capital structure. Accordingly, the Joint Commenting Parties respectfully request rejection of the surcharge proposals and reconsideration of their Joint Motion on Surcharges, which reflects the approach to surcharges that they have agreed upon that will move this project foward.

Proceeding Number A.12-04-019 JOINT MOTION TO REDUCE THE SPECIAL REQUEST 1 SURCHARGE

ABSTRACT: Re: In the Matter of the Application of California American Water Company (U 210 W) for Approval of the Monterey Peninsula Water Supply Project and Authorization to Recover All Present and Future Costs in Rates, JOINT MOTION TO REDUCE THE SPECIAL REQUEST 1 SURCHARGE document is embedded. CONCLUSION Given the delay in the proceeding and the extended period for recovery of preconstruction costs, the Settling Parties’ request to reduce Surcharge 1 from 15% to 4.5% of customer bills is justified. California American Water will still be able to recover costs in a timely manner, but customers will benefit in the meantime from a reduced surcharge on their bills. The Settling Parties urge the Commission to authorize the reduction of Surcharge 1 as soon as possible in order to provide the greatest benefit to its customers.
