REQUEST FOR PROPOSALS: RESIDENT CURATORSHIP FLANDERS MANSION, CITY OF CARMEL-BY-THE-SEA

ABSTRACT: RE: Request for Proposals
The City is seeking proposals for a resident curatorship at Flanders Mansion.
The City of Carmel-by-the-Sea (City) is requesting proposals from individuals interested in entering into a resident curatorship agreement with the City for the rehabilitation, historic restoration and use of the City’s property known as Flanders Mansion (Mansion), located at 25800 Hatton Road in Carmel-by-the-Sea, California.
A curatorship is a public-private partnership in which private individuals donate their time, skills and financial resources to rehabilitate and restore historic buildings located on government-owned land in exchange for the long-term rent-free use of the building. The prospective curator for the Flanders Mansion will be required to rehabilitate, restore, and maintain the Mansion, at his/her own expense, in exchange for the rent-free use of the Mansion as a single-family residence for a term of twenty (20) years.
OPEN HOUSE
The City strongly encourages prospective curators to attend an open house for site and property inspections on either:
Friday, November 9, 2018 from 8 am to 5 pm or
Saturday, November 17, 2018 from 8 am to 4 pm .
Prospective curators may attend both open houses, although it is not required.
SUBMITTING A PROPOSAL
Individuals interested in this curatorship opportunity are required to submit a proposal that includes the components listed in the Request for Proposals.
Proposals submitted without these elements will not be considered by the City for evaluation (i.e. the City will deem the proposal “non-responsive”). Prospective curators are advised to submit proposals that are well organized, detailed, comprehensive and clear so as to ensure a thorough evaluation.
All proposals must be in a sealed envelope and clearly marked “Proposal for Flanders Mansion Resident Curatorship” and must be received by the City by 5:00 PM PST on Wednesday, December 12, 2018.
All proposals and accompanying materials submitted become the property of the City and will not be returned. The City will not considered proposals received after the deadline.
QUESTIONS?
All questions regarding the curatorship and this RFP shall be submitted by email to Sharon Friedrichsen, the City’s Director of Budget and Contracts, at sfriedrichsen@ci.carmel.ca.us     
The deadline for the receipt of questions is 5:00 PM PST on Monday, November 19, 2018. The City anticipates responding to the questions received by no later than 5:00 PM PST on Wednesday, November 28, 2018 and will post the questions and responses on the City’s website. Depending on the nature of the questions, the City may issue an addendum to the RFP. Only such an addendum may extend the due date and time.

ABSTRACT: The Flanders Mansion Lease & Rehabilitation Project document is embedded.  “The City of Carmel-by-the-Sea is seeking the professional services of a leasing agent to find a long-term tenant for an unusual, residential property owned by the City.” “The community's vision is to find a long-term, single-family residential tenant capable of rehabilitating the property. The City would credit the tenant's expenditures for rehabilitation to offset a significant portion of the rent. The lease term is negotiable, but the City has assumed that 20 years (+/-) would be appropriate. In 2013, Conde Nast Traveler readers ranked Carmel as their 6th favorite city in the United States” on the City’s website. Alas, residents and visitors of the City would be better served by city government if the city council and city administration emulated Smithsonian Magazine’s “Best Small Towns to Visit.” Accordingly, if the city council and city administrator were less concerned about budget presentation awards and financial balance sheets and more concerned with the maintenance, upkeep and accessibility of all of Carmel-by-the-Sea's historical, cultural and environmental assets, then perhaps Carmel-by-the-Sea would deserve to be on Smithsonian Magazine’s list of the “Best Small Towns to Visit.”

CITY COUNCIL: ‘Carmel decides to consider other options’ for Flanders Mansion Property

ABSTRACT: The City Council “decided it wanted to step back and look at more options rather than selling the home — a prospect that has triggered lawsuits and years of controversy — or leasing it to someone who would do a full-fledged historical restoration,” according to reporting in The Monterey County Herald. “One would be the possibility of a caretaker-style lease. Another would be to simply hang on to the mansion, do basic maintenance and treat it as another park building, Beach said.” ”The council also said it wanted to have a specialist analyze the historical significance of the building.” EXCERPT HIGHLIGHTS and the National Register of Historic Places Registration Form and photos document for the “Outlands in the Eighty Acres” (Flanders Mansion) are embedded; Flanders Mansion property was placed on the National Register of Historic Places under “local” significance in 1989.

EXCERPT HIGHLIGHTS:

The council, on a 4-1 vote Tuesday, decided against rushing to put a measure on the November ballot to ask voters whether the city should sell the vacant, city-owned mansion in the Mission Trails Nature Preserve.

The action came after a yearlong, unsuccessful effort to lease the 90-year-old Tudor Revival home to a party that would restore it and keep it as a single-family home.

But the council decided it wanted to step back and look at more options rather than selling the home — a prospect that has triggered lawsuits and years of controversy — or leasing it to someone who would do a full-fledged historical restoration.

The council said it wanted to look at three other issues in regard to the Flanders Mansion, which the city bought in 1973.

One would be the possibility of a caretaker-style lease. Another would be to simply hang on to the mansion, do basic maintenance and treat it as another park building, Beach said.
The council also said it wanted to have a specialist analyze the historical significance of the building.

ABSTRACT: The City Council’s Regular Meeting Agenda 8 January 2013 includes Agenda Item VIII. Orders of Council B. Review and consider the Recirculated Final Environmental Report for the Flanders Mansion property, including consideration and determination of several specific questions related to the adequacy of the EIR and the conformity of the EIR to the General Plan. The Staff Recommendation: Staff recommends that the City Council find the 2012 EIR to be adequate. Given that the sole reason for failure of the 2009 EIR was lack of adequacy, however, staff encourages City Council members to carefully review the EIR. Further staff recommendations include:
• Determine that a sale, with mitigations, is consistent with the General Plan;
• Approve either a lease or a sale;
• Limit future occupancy to a single-family residence;
• Select Alternatives 6.7 or 6.5A for the boundary for the sale or lease;
• Determine that all proposed mitigation measures should be adopted; and
• Direct staff and legal counsel to prepare written findings and implementing resolutions for final action at the Council's March 5, 2013 meeting.

PLANNING COMMISSION SPECIAL MEETING: Flanders Mansion Consideration of the re-circulated final Environmental Impact Report for the sale of Flanders Mansion project and advise the City Council on sale of the property and appropriate land uses for conformity with the General Plan

ABSTRACT: Today, the Planning Commission is scheduled to conduct a PUBLIC HEARING on the Flanders Mansion, VI. 1. Consideration of the re-circulated final Environmental Impact Report for the sale of Flanders Mansion project and advise the City Council on sale of the property and appropriate land uses for conformity with the General Plan. The STAFF REPORT RECOMMENDATION:
Assuming adoption of all of the mitigation measures in the EIR, all of the following sale alternatives appear consistent with the General Plan and reasonably consistent with the findings in the EIR (these are not ranked by staff):
6.6: Sale of Reduced Parcel--building only, plus a small area of adjacent land
6.5: Sale with Conservation Easements and Mitigations (all 1.252 acres)
6.5A: Sale of Reduced Parcel--remove easement areas from Alternative 6.5
6.7: Sale of Reduced Parcel--remove easement areas from Alternative 6.5, remove the driveway and add new trail connections.

FOREST & BEACH COMMISSION AGENDA ITEM Consideration of the recirculated final environmental impact report for the sale of Flanders Mansion Project and advise the Planning Commission on its adequacy regarding historical, cultural and aesthetic resources, 10 December 2012

ABSTRACT: On Monday, 10 December 2012, the Forest and Beach Commission held a Special Meeting concerning ORDERS OF BUSINESS 1. Consideration of the recirculated final environmental impact report for the sale of Flanders Mansion Project and advise the Planning Commission on its adequacy regarding historical, cultural and aesthetic resources. The site is located at Flanders Mansion, 25800 Hatton Road.
STAFF COMMENTS AND RECOMMENDATIONS
The discussion in the EIR is comprehensive and thorough enough to disclose the project's impacts related to the Mission Trails Nature Preserve and its adjacent neighborhood. Mitigation measures are identified for each impact and the document acknowledges that loss of public parkland will remain a significant impact even with mitigations. Project alternatives are identified to further explore means to reduce potential impacts. All public comments, including the consideration of smaller parcel sizes, have received a thorough response. Taken as a whole, the EIR appears adequate to supply the Council with enough, appropriate information about impacts, mitigations and project alternatives to make informed decisions about the project.
Staff recommends that the Forest, Parks and Beach Commission advise the Planning Commission that the EIR is adequate. If the Commission has other comments or recommendations to make, these will also be forwarded to the Council.

HISTORIC RESOURCES BOARD AGENDA ITEM Consideration of the recirculated final environmental impact report for the sale of Flanders Mansion Project and advise the Planning Commission on its adequacy regarding historical, cultural and aesthetic resources, 10 December 2012

ABSTRACT: On Monday, 10 December 2012, the Historic Resources Board held a Special Meeting concerning APPLICATIONS Consideration of the recirculated final environmental impact report for the sale of Flanders Mansion Project and advise the Planning Commission on its adequacy regarding historical, cultural and aesthetic resources.
STAFF COMMENTS AND RECOMMENDATIONS
The proposed project, or any alternative that transfers control of the Flanders Mansion to another party, could result in changes that diminish the integrity of the historical resource and limit the public's enjoyment of the building. These effects would not be consistent with the City's policies of preserving historical resources and encouraging public enjoyment of them. The EIR correctly identifies these as potentially significant impacts. The EIR also identifies mitigation measures that would reduce these potential impacts. All of this was accepted by the Court.
The discussion in the EIR is comprehensive and thorough enough to disclose the project's impacts related to historical, cultural and aesthetic resources. The mitigation measures identified in the document would reduce the significance of these impacts to a less-than-significant level. Taken as a whole, the EIR appears adequate to supply the Council with enough, appropriate information about impacts, alternatives and mitigations to make informed decisions about the project. The Historic Resources Board reviewed the 2009 EIR on 20 April 2009 and forwarded a recommendation to the Planning Commission that the EIR was adequate. The 2012 EIR contains additional analysis and a more thorough response to public comments.
For all of these reasons, staff recommends that the Historic Resources Board forward a recommendation to the Planning Commission that the 2012 EIR is adequate for reviewing impacts, alternatives and mitigations regarding historic preservation, cultural resources and aesthetic resources related to public enjoyment of the Flanders Mansion as a historical resource. Staff also recommends forwarding the attached advice from the Board's 2009 review of the EIR. It remains valid and would strengthen the mitigation measures. If the Board has other comments or recommendations to make, these will also be forwarded to the Planning Commission and to the City Council.

ABSTRACT: The Final Recirculated Draft EIR (RDEIR) Revised Alternative Section Responses to Comments, FINAL ENVIRONMENTAL IMPACT REPORT for the FLANDERS MANSION, dated November 30, 2012, and prepared by Denise Duffy & Associates, Inc. for the City of Carmel-by-the-Sea, was made available to the public on December 6, 2012.
