PUC ALJ RULING: ‘PUC administrative law judge Gary Weatherford postponed deadlines for testimony in the water project proceedings’

ABSTRACT: “Review of California American Water's proposed water supply project at the state Public Utilities Commission has been delayed indefinitely because of questions about potential obstacles,” according to reporting in The Monterey County Herald. Furthermore, “In a ruling issued last week, PUC administrative law judge Gary Weatherford postponed deadlines for testimony in the water project proceedings to allow more time to consider a range of issues raised during a technical workshop last month.” In addition, “On Thursday, the authority board agreed to hire Carlsbad-based Separation Processes, Inc.known as SPI, to do at least part of the study aimed at comparing proposals from California American Water, The People's Project and DeepWater Desal.  SPI agreed to cover the cost comparison portion of the study for $60,000, while acknowledging it doesn't have enough expertise in financing, permitting and environmental review to cover those areas, and offered to hire a subconsultant for that work. SPI estimated it would take four to five weeks to finish the cost comparison, which is expected to cover both capital and ongoing operations and maintenance.”

After rejecting the first consultant, the Water Authority decided on SPI and a subconsultant to perform the cost comparison study on the three water projects which is estimated to take about 3-4 weeks to complete. O.K. But comments made by Mayor Burnett suggest that the Water Authority is not in the slighest interested in stepping up and taking some responsibility for financing or ownership, as even Councilman Hillyard urged. And other similiar studies are being done by at least one other entity. There is uncetainly then about what constructive contribution or role the Water Authority really it playing towards a real solution to the cease and desist order.
