ABSTRACT:  Eight Noteworthy 4 May 2015 City Council Special Meeting Agenda Items, namely CLOSED SESSION, Monthly Reports for March, Report from Small Water Conservation Projects Committee and Initial Committee Recommendations, Contract Amendment: Monterey Bay Planning Services (MBPS), Contract Amendment: Rincon Consultants, Inc., 2014 Streets Paving Restoration and Supplemental Appropriation, Final Adoption of Ordinance amending the Purchasing Policy and Consideration of an appeal of the Planning Commission’s approval of Coastal Development Permit (MP 15-100) for the beach fire management pilot program located along and seaward of Scenic Avenue from Eighth Avenue to Martin Way on Scenic Road, in the Improved Parklands Overlay (P-2), and Beach and Riparian Overlay (BR) Zoning Districts. 4. CONSENT CALENDAR
All items on the Consent Calendar are to be acted upon by a single action of the City Council unless otherwise requested by an individual Council Member or the public for special consideration. Otherwise the recommendation of staff will be accepted and acted upon by majority voice vote.

Recommendation: Accept the reports.


4.D Report from Small Water Conservation Projects Committee and Initial Committee Recommendations
Recommendation: Receive a status report from the Small Water Conservation Projects Committee, and approve the Committee’s recommendations: (1) to have the City waive Planning and Building Permit fees for water collection cisterns and other water collection, water conservation, and grey water projects, and (2) to direct staff to replace fixtures at City facilities with low-flow and other water conservation fixtures.


4.F Contract Amendment: Monterey Bay Planning Services (MBPS)
Recommendation: Adopt a resolution authorizing the City Administrator to execute Amendment No. 1 to a Professional Services Agreement with Monterey Bay Planning Services in the amount of $15,000 for contract planning services.


4.G Contract Amendment: Rincon Consultants, Inc.
Recommendation: Adopt a resolution authorizing the City Administrator to execute Amendment No. 3 to a Professional Services Agreement with Rincon Consultants Inc. in the amount of $82,000 for contract planning services.


4.K 2014 Streets Paving Restoration and Supplemental Appropriation
Recommendation: Adopt a resolution to: 1) Authorize the City Administrator to execute an Agreement for Paving Restoration for Encroachment Permit EN TEMP 13-03 with Pacific Gas and Electric (PG&E); and 2) Recognize unanticipated revenue and approve an adjustment of a minimum of $200,580 to revenues and expenditures for the 2014 Street Project; and 3) Approve a supplemental appropriation request of a maximum of $285,250 to fund Phase II of the 2014 Streets Project and adjust Project revenues and expenditures accordingly.


4L. Final Adoption of Ordinance amending the Purchasing Policy
Recommendation: Adopt Ordinance 2015-001 amending Title 3, Chapter 12 of the City’s Municipal Code pertaining to the purchasing system.


7. PUBLIC HEARINGS
Public Hearings consist of Zoning amendments, General Plan amendments, appeals of Commission decisions and other State- mandated items. If the Public Hearing is an appeal, appellants are allowed a total of 10 minutes to speak on their own behalf after the staff report and at the close of public comment in order to have an opportunity to rebut public comments. Other speakers will be allowed three minutes.

7.A Consideration of an appeal of the Planning Commission’s approval of Coastal Development Permit (MP 15-100) for the beach fire management pilot program located along and seaward of Scenic Avenue from Eighth Avenue to Martin Way on Scenic Road, in the Improved Parklands Overlay (P-2), and Beach and Riparian Overlay (BR) Zoning Districts. The application is being appealed by Nancy Chira-Garcia, Bill Shellooe, Mary Louise Shellooe and Alexis Delehanty
Recommendation: Remand the project to the Planning Commission for consideration of revisions to the management plan direct Staff to initiate additional enforcement of existing regulations specifically related to the designated area for beach fires.
